Court sets schedule for ballot lawsuit

On Monday, April 13, the Superior Court of Yavapai County set the initial schedule of the city of Sedona’s legal challenge on the legality of Proposition 403 that is seeking to ask voters to bar the ability of the city to construct housing at the Western Gateway.

“The court set a deadline of Friday, April 17, to file summary judgment motions,” Save Sedona Committee Political Action Committee Treasurer Bill Noonan said. “The parties will file responses to those motions by Friday, April 24, and then the court is going to hold an oral argument on Wednesday, April 29, from 10 a.m. to noon, and it is possible that the judge would issue a decision.”

The PAC circulated petitions to put the question to voters on the Tuesday, July 21, Primary Election ballot before submitting about 1,400 signatures to the city clerk’s office on March 19. The city of Sedona filed its lawsuit on March 31, with the Phoenix-based Herrera Arellano law firm, citing constitutional concerns.

“If the court makes a decision on Wednesday, April 29, that would start at a period of time for an expedited appeal that needs to be quick enough to fully resolve all of the issues before the ballot printing deadline,” Noonan said. “To my knowledge, the earliest relevant ballot printing deadline is Friday, May 22, for Coconino County.”
